§ 1 - Scope & provider identification

(1) For online goods orders via the website www.schmuckejungs.com, the following general terms and conditions apply exclusively

Unless otherwise agreed, the inclusion of any terms you may have used is contradicted.

(2) A consumer within the meaning of the following regulations is any natural person who concludes a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their self-employed professional activity. An entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their independent professional or commercial activity.

(3) The version of these GTC valid at the time of the order applies.

(4) The prices at the time of the order apply. Promotional offers in our shop may be limited in time or quantity. Details can be found in the product description.

 

§ 2 - Formation of the contract

(1) The subject of the contract is the sale of goods. Our (silver and gold-plated fashion jewellery) on the Internet are non-binding and not a binding offer to conclude a contract.

(2) You can submit a binding purchase offer (order) via the online shopping cart system. You order in our shop by going through the following steps:


1.) You place the item in your shopping cart without obligation by clicking on the "Add to shopping cart" button. 

2.) You can view all items that you have placed in the shopping cart by clicking on the shopping symbol in the navigation bar. You can make changes here at any time.
3.) If you want to buy the items from your shopping cart, then click on the "Checkout" button. This will take you to the ordering process, which consists of 4 steps.

In the first step you have to enter your personal data and address. In the second step, select your shipping method. In the third step, select your payment method. In the fourth step, you will receive an overview of all the data for your planned order on a control page (in particular billing and delivery address, product, price, quantity, payment method). Here you will be asked to confirm the correctness of your information. You can also correct or change your order data here by clicking on "change".
4.) If you use the "PayPal - Express" instant payment system by clicking on the appropriately designated button integrated in the shop system, you will be forwarded to the PayPal log-in page. After successful registration, your address and account data stored with PayPal will be displayed. Clicking on the "Continue" button will take you back to the order overview page in our online shop. Before sending the order, you have the option of checking all the information again, changing it (also using the "back" function of the Internet browser) or canceling the purchase.
5.) By clicking on the "Order with costs" button, you submit a binding offer to us. In doing so, you offer us the conclusion of a purchase contract.

With the selected payment methods credit card, Paypal and Instant bank transfer (Klarna), you will be forwarded to the respective service provider at the end of the ordering process in order to complete the payment process there.

(3) After you have sent your order, we will send you an e-mail confirming receipt of your order and listing its details (acknowledgment of receipt). This confirmation of receipt does not constitute acceptance of your offer, but is only intended to inform you that we have received your order. We can accept your order by sending a shipping confirmation email or by delivering the ordered goods within five days.

We save the text of the contract and send you the order data by e-mail. The terms and conditions can be viewed at any time (Conditions). If you have a customer account, you can view your order data in your account. As a non-registered user, the order data is no longer accessible via the Internet for security reasons.

 

§ 3 - Customized Goods

(1) You provide us with the appropriate information or texts required for the individual design of the goods prior to the conclusion of the contract.

(2) You undertake not to transmit any data whose content infringes the rights of third parties (in particular copyrights, naming rights, trademark rights) or violates existing laws. You expressly release us from all third-party claims asserted in this context. This also applies to the costs of the legal representation required in this context.

(3) We do not check the transmitted data for correctness of content and assume no liability for errors in this respect.

(4) The exchange of individually designed goods is excluded.

 

§ 4 - Data protection

We provide within our data protection on www.dimensionsjewellery.com additional information on data protection as well as the type, scope and purpose of the collection and use of personal data on our part.

 

§ 5 - Right of withdrawal for consumers

(Consumers are entitled to a statutory right of withdrawal. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed.)

You have the right to withdraw from this contract within fourteen days without giving a reason.

The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the last goods.
With us you have an additional voluntary right of return of 16 days after the statutory right of withdrawal of 14 days has expired. The statutory right of withdrawal exists independently of this and is not restricted by it.

by means of a clear statement (e.g. a letter sent by post or e-mail) of your decision to withdraw from this contract. You can use the attached sample revocation form for this, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.

 

Consequences of revocation

If you revoke this contract, we have paid you all payments that we have received from you, including the delivery costs (except for the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment. We may refuse repayment until we have received the returned goods or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired. The buyer bears the cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

 

Exclusion of the right of withdrawal

Unless the parties have agreed otherwise, the right of withdrawal does not apply to the following contracts: Contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer are tailored.

§ 6 - Delivery of the goods

(1) Jörg-Hendrik Meyer - DIMENSIONS delivers to delivery addresses in Germany and worldwide.  

(2)  Shipping costs (including VAT) are free within Germany. For shipments to a delivery address inside and outside the EU, a flat rate shipping fee of EUR 6.99 is charged. From an order value of 50 euros, deliveries within and outside the EU are free of charge. Please note that deliveries to non-EU countries may incur additional customs fees.

(3) Unless a different period is specified in the item description, the goods will be delivered in Germany within 1 - 3 days by post/DHL after receipt of the order confirmation, for deliveries abroad within 3 - 5 days after the order confirmation (if advance payment has been agreed). after the time of your payment instruction). Please note that there is no delivery on Sundays and public holidays. If you have ordered items with different delivery times, we will ship the goods in one shipment, unless we have made any other agreements with you. In this case, the delivery time is determined by the item with the longest delivery time that you have ordered.

 

(4) Upon request, express delivery can be made within Germany for a surcharge of EUR 10. Orders received before 12 noon Monday to Friday are delivered the next day. Goods ordered in this way on a Saturday or Sunday will be delivered on the following Tuesday, provided the previous Monday is not a public holiday.

 

(5) It is pointed out that public holidays are not nationwide and the services are provided in different federal states, e.g. B. Bavaria. The above-mentioned special features for public holidays therefore apply to public holidays in the respective federal states in which service providers are involved in processing an order.

(6) In the event of delays in delivery, we will inform you immediately.

(7) If the ordered goods are not available, we reserve the right not to deliver. In this case, we will inform you immediately and immediately refund any consideration already received.

 

 

(1) The purchase price is due upon complete delivery.

(2) For deliveries within Germany you have the following payment options:

 

  • For the credit card payment method, a payment limit of up to EUR 4,000 applies to both registered and unregistered customers. The credit card will be charged on the day the goods are dispatched.

  • You can choose PayPal as a payment method at any time, both as an unregistered and as a registered customer. Your account will be debited upon completion of the order in the online shop.

  • Pay by bank transfer in advance. After sending the order, we will send you an e-mail containing all other bank details.
    Please note that it may take 2-3 business days to process your payment and shipping will be delayed accordingly.

  • Only one discount can be redeemed per order. In the event of a full return or cancellation, the bonus of a discount code that was not purchased will be forfeited. Price advantage campaigns and customer discounts only apply until revoked. In the case of temporary discount campaigns, the terms of use for the respective campaign also apply. The specified minimum purchase value applies to discount campaigns. This refers to the value of the retained goods.

 

(3) For deliveries abroad, you have the following payment options:

(4) The delivered goods remain the property of Jörg-Hendrik Meyer- DIMENSIONS until full payment has been made.

(5) You can only exercise a right of retention insofar as it concerns claims from the same contractual relationship.

(6) All prices include the statutory VAT.

§ 8 - Warranty

(1) The product images may differ from the appearance of the delivered products.

(2) If the goods are defective, we will provide supplementary performance within a reasonable period of time, ie either a replacement delivery or the elimination of the defects. The place of performance for the supplementary performance is our registered office. If the supplementary performance you have chosen is only possible at disproportionate expense, we are entitled to supplementary performance in another form. The expenses required for the subsequent performance shall be borne by us. If a reasonable period of time for supplementary performance has elapsed without result, you have the right, at your choice, to cancel the purchase contract or reduce the purchase price.

(3) If you decide to cancel the purchase contract, the services received by both parties must be returned and any benefits derived must be surrendered. If you cannot return the service received to us in whole or in part, or only in a deteriorated condition, you may have to pay us compensation for the value. However, the deterioration caused by the intended use is not taken into account.

(4) Claims for defects become time-barred two years after the delivery of the goods.

(5) The statutory rights of the consumer in the context of warranty/liability for defects apply.

 

§ 9 - Compensation for damages

(1) Compensation for breach of an obligation arising from the contractual relationship is to be paid under the statutory requirements. The same applies to claims for damages based on the Product Liability Act. All instructions on the packaging and inserts must be observed. No liability is assumed for any application and/or handling that deviates from this.

(2) According to the current state of the art, data communication via the Internet cannot be guaranteed to be error-free and/or available at all times. In this respect, we are not liable for the constant or uninterrupted availability of the website and the service offered there.

 

§ 10 Choice of Law, Place of Performance, Place of Jurisdiction

(1) German law applies. For consumers, this choice of law only applies insofar as the protection provided by mandatory provisions of the law of the state of the consumer's habitual residence is not withdrawn (principle of favourability).

(2) The place of performance for all services arising from the business relationship with us and the place of jurisdiction is our registered office if you are not a consumer but a merchant, a legal entity under public law or a special fund under public law. The same applies if you do not have a general place of jurisdiction in Germany or the EU or if your domicile or habitual abode is not known at the time the action is filed. The authority to appeal to the court at another legal place of jurisdiction remains unaffected.

(3) The provisions of the UN Sales Convention expressly do not apply.

 

§ 11 Miscellaneous

(1) Online gift vouchers cannot be paid out in cash.

(2) The law of the Federal Republic of Germany applies. However, the United Nations Convention on Contracts for the International Sale of Goods (CISG) of April 11, 1980 does not apply.

(3) Complaints are to be made to the address specified in § 1.

(4) European online dispute resolution platform: From February 15, 2016, the EU Commission will provide a platform for out-of-court dispute resolution. This gives consumers the opportunity to initially settle disputes in connection with their online order without going to court. (3) If you request an offer outside of the online shopping cart system, you will receive all contract data as part of a binding offer by email, which you can print out or save electronically.

5. Prices and terms of payment

(1) The prices listed in the respective offers and the shipping costs represent total prices. They include all price components including all applicable taxes.

(2) The shipping costs incurred within Germany are included in the purchase price. Shipping costs within and outside the EU can be called up via a correspondingly designated button on our website or in the respective item description, are shown separately in the course of the ordering process and are to be borne by you in addition, unless free shipping has been promised.

(3) The payment methods available to you are shown under a correspondingly designated button on our website.

(4) Unless otherwise stated for the individual payment methods, the payment claims from the concluded contract are due for payment immediately.

 

6. Terms of Delivery

(1) The delivery conditions, the delivery date and any existing delivery restrictions can be found under a correspondingly designated button on our website or in the respective item description.

(2) If you are a consumer, it is regulated by law that the risk of accidental loss and accidental deterioration of the item sold during shipment only passes to you when the goods are handed over to you, regardless of whether the shipment is insured or uninsured. This does not apply if you have independently commissioned a transport company not named by the contractor or another person responsible for carrying out the shipment.

 

7. Statutory liability for defects

(1) The liability for defects for our goods is based on the "Warranty" provision in our General Terms and Conditions (Part I).

(2) As a consumer, you are asked to check the goods immediately upon delivery for completeness, obvious defects and transport damage and to inform us as soon as possible. If you do not comply, this has no effect on your statutory warranty claims.
